Why do I need a QDRO?

A “QDRO” refers to the court order needed to divide retirement benefits in divorce. Unlike other community or marital property, retirement plans are not automatically divided.


Even if your divorce judgement states how the retirement is divided between the parties, it will not actually be divided unless you have a QDRO. A QDRO is required during or even after a divorce is final.

A QDRO can also be used to collect alimony or child support.

When does a QDRO take effect?

QDROs go into effect when a court filed QDRO is submitted to the plan administrator and they complete their administrative tasks.

Where to file a QDRO

A QDRO is filed under the same jurisdiction (Court house) your divorce was filed in. 

Who initiates the QDRO

There is no rule as to who should initiate a QDRO; either party can initiate the QDRO process.

Who pays the QDRO fees?

There is no obligation for either of the parties to pay for the QDRO; it is common practice to split the cost between both parties.

Why is a QDRO necessary?

A QDRO is a document qualified by the court instructing a pension plan administrator on how to divide a plan. Without a QDRO, the plan administrator will not distribute funds.
