Why do I need a QDRO?
A “QDRO” refers to the court order needed to divide retirement benefits in divorce. Unlike other community or marital property, retirement plans are not automatically divided.
Even if your divorce judgement states how the retirement is divided between the parties, it will not actually be divided unless you have a QDRO. A QDRO is required during or even after a divorce is final.
A QDRO can also be used to collect alimony or child support.

When do you need a QDRO?
When you get a divorce, the only way to get money paid from one spouse’s retirement account to the other spouse is with a QDRO.
A QDRO (sounds like ‘Quad-ro’) is a court order required to divide retirement accounts. A QDRO allows for payment to the other spouse for marital or community property and also to collect alimony or child support. You need a domestic relations order to divide all types of retirement plans whether from a private company or a public entity.

QDROs go into effect when a court filed QDRO is submitted to the plan administrator and they complete their administrative tasks.
A QDRO is filed under the same jurisdiction (Court house) your divorce was filed in.
There is no rule as to who should initiate a QDRO; either party can initiate the QDRO process.
There is no obligation for either of the parties to pay for the QDRO; it is common practice to split the cost between both parties.
